Surrogacy In Mexico

Mexico Surrogacy A Comprehensive Overview

In 2021, the Mexican Supreme Court sanctioned surrogacy as a protected medical procedure, offering a viable option for singles and couples, regardless of sexual orientation, to build their families through an affordable arrangement.

Although legally endorsed, surrogacy implementation varies across Mexican states, with select regions being more supportive. Gestational surrogacy is the sole permissible method, prohibiting the surrogate from using her own eggs.

Despite being a developing country, Mexico provides a cost-effective international surrogacy alternative, with some agencies boasting a decade-long track record and programs priced at one-third of those in the United States.

Surrogacy services are burgeoning, particularly in Cancun and Mexico City, with anonymous egg donors available. Non-Mexican donors, including Caucasian or Asian donors, can be engaged, offering fresh or frozen eggs.

Post-birth procedures involve registering the newborn in compliance with Mexican law, typically taking 1-2 days. International surrogacy necessitates at least one genetic parent holding citizenship in the baby’s country of residence, along with a post-birth DNA test for paternity confirmation.

While the child is granted Mexican citizenship and passport, obtaining travel documents from the baby’s home country is quicker. The duration of stay in Mexico post-birth varies from 3 to 12 weeks, with potential assistance from migration agents.

Surrogacy laws are state-regulated, akin to the United States, Canada, and Australia, following the Supreme Court’s protection decree. However, challenges may arise for intended parents lacking genetic ties to the baby in acquiring citizenship and passports for the newborn, mandating at least one genetic parent to hold citizenship in the destination country.
